General terms and conditions

 

 Before confirming a reservation, we recommend that you carefully read the following terms and conditions.

 

 797 REAL ESTATE & PROPERTY MANAGER SL is a company registered in Spain with CIF number B02814754, which operates commercially under the name of 797 HOLIDAY RENTALS, hereinafter called 797 HOLIDAY RENTALS.

 

 Prices

 

 The prices shown on the "company" website are per apartment and per night, unless otherwise indicated. All prices are in euros unless otherwise stated. Prices include all applicable taxes. Prices are subject to change at any time without affecting existing reservations, except for any changes in legal or regulatory taxes imposed by the competent authorities.

 

The prices will indicate the amount of the complete cleaning of the property before and after the arrival and departure of each guest; Prices include property maintenance, cost of water, electricity, gas and internet, customer service during office hours.

Extras such as cleaning, cots, high chair, etc. are available at additional cost.

 

Conditions of the reservation process

 

After you have made a reservation for one of our accommodations, you will receive a written confirmation with the dates and prices of the accommodation you have reserved, the payment terms and any additional services you have reserved. You will receive a confirmation explaining how to get to the accommodation where one of our employees will be waiting for you to give you the keys to the accommodation, show you around and answer any questions you may have.

 

Payment Methods and Reservation Fees To make a reservation, you must pay the reservation fee to reserve the accommodation. Payment of these reservation fees will formalize your contractual relationship with 797 HOLIDAY RENTALS.

 

Payment conditions:

• The reservation fee corresponds to 30% of the total price of the reservation, depending on the accommodation.

You will be charged immediately after booking.

 

• Once paid, these reservation fees are non-refundable (except conditions established in our cancellation policy).

• The remaining balance must be credited in cash or card on the day of arrival. Please contact us if you need special payment terms. • If you booked your apartment or property through a third-party provider (eg Airbnb, Booking.com, HomeAway, etc.), please note that you are subject to the terms and conditions of that third-party provider, whether for payment , reservation or cancellation. Reservation Change In general, we cannot change a reservation after it is confirmed. However, if you wish to change any aspect of a reservation, please let us know as soon as possible by contacting us via email: info@797holidayrentals.com.

We will do our best to help where we can. Cancellation Policy Cancellations must be made in writing to info@797holidayrentals.com. The following cancellation fees apply: • Within 5 days prior to arrival: Loss of reservation fee • 29 - 14 days prior to arrival: 50% of the total rental price. If, due to circumstances, the apartment is not available for occupancy, 'the company' reserves the right to transfer you to alternative accommodation with similar characteristics at no additional cost. If for any reason we are unable to relocate you or provide alternative accommodation, 'the company' reserves the right to relocate you at no additional cost. If 'the company' cannot find a substitute location, the reservation will be canceled and a full refund will be given. However, if a reservation is canceled due to causes attributable to the guest or their personal circumstances, the reservation fee will not be refunded.

 

Access to accommodation

 

 Check-in The check-in and check-out times may vary depending on the accommodation, but as a general rule, the check-in time is from 3:00 p.m. on the first day of the reservation confirmation, regardless of the arrival time. We do everything possible to reduce waiting times.

In cases where the accommodation is available before the indicated time, we will try to let you in earlier. If you experience a change in travel plans or arrival time in Malaga or have an unexpected event that prevents you from arriving at your accommodation at the agreed time, please let us know as soon as possible to arrange a new time. We kindly ask you to inform us upon your arrival at Malaga airport, or 30 minutes before arrival at the apartment, so that we can make sure that we are there to welcome you. In case you are unable to reach your designated contact person, please contact our emergency number: 34 951 444 822 Contract and registration On arrival or before your arrival you must sign a police register that includes last name, first name and passport details. This procedure is mandatory for guests over 15 years of age, in accordance with current Spanish legislation. Any guest who refuses to do so will not have access to the property without this procedure.

Late arrival Check-in outside office hours carries the following charges: 40. This amount must be paid in cash upon arrival. Departure from the accommodation / Check out In general, check-out and return of keys is done before 10:00/11:00 depending on the property on the last day indicated on the reservation confirmation. Please ensure that all sets of keys received on arrival are returned to your contact person. Upon request and always subject to availability, the departure time can be extended. For example, if you require additional time in the apartment due to a late flight, we will do our best to accommodate your request, as long as the apartment is not occupied and/or cleaned.

 

Cleaning and bedding.

 

 Full cleaning is provided before and after the departure of new guests. Weekly cleaning is not included during longer stays, ie stays of 2 weeks or more, but additional cleaning can always be arranged at additional cost. Thorough final cleaning is included in the price, but we kindly ask our guests to leave the property in a tidy condition, remove debris and clean dirty dishes as a courtesy to our cleaners and future guests. Please note that we provide one large towel (140x70cm) and one medium towel (100x50cm) per person. If you require additional bedding during your stay, we can arrange this for a small additional charge.

Special requests.

 

Our goal is to meet the needs of our guests. Please contact us if you need an additional service or a special request. We will do our best to make your stay as pleasant as possible. People with reduced mobility A limited number of accommodations in our portfolio are easily accessible and may be suitable for special needs. If you need more information, please contact us before booking and we will be happy to help you.

Number of guests The maximum number of guests allowed in an apartment is indicated in the descriptions of each accommodation. For health and safety reasons, it is not allowed to use the accommodation for a number of guests greater than that indicated in the reservation confirmation. Failure to comply with this rule may constitute grounds for termination of the contract by "the Company" and reserves the right, if it deems it necessary, to expel unconfirmed guests in the original reservation.

 

 

 At 797 Holiday Rentals we want our guests to enjoy their stay. We ask everyone to maintain respectful and social behavior, both at home and with neighbors. Please note that while you may be on vacation, you will be staying on private property surrounded by locals. If for any reason there is a complaint, claim or complaint from the neighbors or from the competent authority for the behavior of one or more guests, you may be asked to leave the property and there will be no refund. In addition, any damage or breakage will be deducted from the deposit. Please note that most communities in Spain have their own rules that guests must abide by.

In general, we ask that you do not: • Damage furniture or property. • Make noise after 23:00 in the apartment, on the terrace or in the common areas. • Disturbing the neighbors by opening/closing doors, carrying suitcases, etc. • Have noisy parties or parties in the apartment. • Organize illegal activities on the premises. • Smoking on the property. (Violating this rule results in a fine of €100,-) • Bringing pets to the property.

 

Note that:

 • The owner of the accommodation (or 797 Holiday Rentals on behalf of the owner) reserves the right to remove the guest (s) without refund if the rules of the property are not followed. • 797 Holiday Rentals is not responsible in case of theft or accident on the property.

 • 797 Holiday Rentals is not responsible for the noise generated by urban works, road works, alterations or construction of new buildings and other disturbances caused by external factors.

 • 797 Holiday Rentals is not responsible in the event that a specific property is unfit for occupancy due to violence, the elderly, acts of God, etc.

• Some apartments or features may be changed, replaced or eliminated at any time without notice. Pets Please note that pets are not allowed in our accommodations. If you are traveling with a guide dog (eg visually impaired, police dogs, etc.), please contact us before booking so we can find a suitable accommodation for you.

 

If you have any complaints during your stay, please let us know as soon as possible so we can resolve them immediately. The company will not accept any claim made after your stay. We will always do everything in our power to resolve any complaint that may arise in the most efficient manner possible. Please note that an official Andalusian government claim form is available upon request.

Down Payment.

 A deposit is required. The deposit will be returned upon departure, provided that during the inspection no anomaly, breakage or defect is found in the property, furniture, electrical appliances and other elements. If this is found, these will be deducted from the refund of the deposit. We reserve the right to use all or part of the deposit to cover the cost of any repair or replacement that we have had to carry out. The deposit varies from property to property, but is generally between €300 and €1,000.

accommodation changes

Changes in the reserved accommodation in case of force majeure, fortuitous event, maintenance problem, etc., the company reserves the right to change the assigned accommodation for another of an equivalent level or higher than the amount reserved, with your approval, or proceed to refund the full cost of the reservation.

Responsibility

• "The Company" does not assume any responsibility for lost or misplaced luggage, theft, damage or accidents not related to the management of "the Company" itself. - The guest undertakes to make good use of the rented accommodation, thus exempting "the company" from any responsibility; The guest may be liable for damage caused intentionally or otherwise by improper use of the accommodation.

• The Company reserves the right to update any of these terms at any time if necessary in accordance with the activity of "the Company".

• The protection of users' personal data by 797 REAL ESTATE & PROPERTY MANAGER SL. is in accordance with Organic Law 15/1999 on the Protection of Personal Data, we inform you that your data is kept in the file for which 'the company' is responsible, whose purpose is property management.

• It is also used, and whenever the client has been listed, to inform related services, offers and marketing campaigns.

• The online reservation of user services is voluntary with the provision of personal data (hereinafter "personal data") whose sole purpose is to complete the reservation.

• The data made by the payment card company, in a payment gateway belonging to the bank with which this service company has subscribed or made in a secure environment, in which case 'the company' will not know said data.

• Clients may exercise their rights of access, opposition, rectification and deletion of data by writing to the company, 797 REAL ESTATE & PROPERTY MANAGER S.L., Avenida ciudad de melilla 40, 29631 Benalmadena (Málaga, Spain). The company guarantees that it has adopted the appropriate security measures in its facilities, systems and files. It also guarantees the confidentiality of "personal data", but discloses to the competent authorities the "personal data" and other information in its possession or accessible through its systems and is required by the laws and regulations applicable to this case. • System users guarantee the online reservation and, in any case, the veracity, accuracy, validity and authenticity of the 'personal data', and adhere to keeping 'the company' informed.

 

Governing Law and Jurisdiction

• These terms and conditions and/or general conditions are governed by Spanish law.

• 797 HOLIDAY RENTALS and users to resolve any dispute that may arise regarding its validity, execution or termination, in whole or in part, submit, expressly waiving their own jurisdiction or others that, where appropriate, may correspond to the jurisdiction of the courts and tribunals of the city of Malaga.

• This contract constitutes the full and complete agreement between 797 REAL ESTATE & PROPERTY MANAGER S.L. and the user, and supersedes all prior commitments, representations or agreements, written or oral, that have previously existed between them.
